Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. Coupon codes are not combine-able.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

 

SECTION 6 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In no case shall Rouse Home, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Rouse Home and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

SECTION 15 – SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

SECTION 16 – TERMINATION

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

 

SECTION 17 – ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

 

SECTION 18 – GOVERNING LAW

THESE TERMS, YOUR ACCESS TO AND USE OF THE SERVICES, AND YOUR ORDER, RECEIPT AND USE OF PRODUCTS AND SERVICES YOU PURCHASE FROM US SHALL BE GOVERNED BY AND CONSTRUED AND ENFORCED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW YORK, WITHOUT REGARD TO CONFLICT OF LAW RULES OR PRINCIPLES (WHETHER OF THE STATE OF NEW YORK OR ANY OTHER JURISDICTION) THAT WOULD CAUSE THE APPLICATION OF THE LAWS OF ANY OTHER JURISDICTION. ANY DISPUTE BETWEEN THE PARTIES THAT CANNOT BE HEARD IN SMALL CLAIMS COURT, SHALL BE RESOLVED IN THE STATE OR FEDERAL COURTS OF NEW YORK COUNTY, NEW YORK.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

 

SECTION 20 – TRADE PROGRAM

• Membership is contingent upon receipt of appropriate credentials and completed application.
• Non-designer related businesses and professions may not qualify for the program.
• Program is available solely to member; discount privilege is non-transferable to clients, purchasing agents or any third party.
• Member must place and pay for order. We do not accept payment from clients.
• There is no discount on shipping charges.
• Some items are excluded from the Trade discount.
• By accepting membership to Rouse Home Trade Program, you agree that you will purchase Rouse Home product for the sole purpose of conducting business with an individual client, and that you will not resell such merchandise to the general public through retail stores, the internet, printed materials, or any other means.
• As a member of Rouse Home’s Trade program, you are granted the authority to reproduce images as is required to conduct business with your individual interior design and decorating clients.
• Membership may be denied or terminated at any time, with or without cause, at Rouse Home’s sole discretion.

 

SECTION 21- RETURNS POLICIES

You may return your order within 5 days of your receipt of merchandise for a refund of the purchase price less shipping costs and a 20% restocking fee on full retail price before any discounts. Shipping and handling charges are non-refundable. The outbound and return shipping costs are the responsibility of the customer and we recommend that all return shipments be insured. Note that all returns must be in new condition and in the original packaging. Taxes charged are refunded in accordance with state and local laws. Please allow up to 5 business days for your refund to be credited to your account. It is required that all refund requests be submitted in writing via email. To request a refund, email us at customercare@rousehome.com and we will assist you promptly. Please see below for return exceptions.

 

SECTION 22 – RETURNS EXCEPTIONS

We are unable to accept returns for:

• Products that are clearly marked non-returnable on the Product Detail Page

• Products that have been assembled or installed

• Products without original packaging or not in their original condition

• Custom orders, including those that are made-to-order or customized to your specifications

• Open-box or clearance items

 

SECTION 23 – CANCELLATIONS POLICIES

Once we receive your order we get to work on it right away, therefore it may not be possible to cancel an order that is in process. To request a cancellation please email us at customercare@rousehome.com and we will attempt to stop or modify the order. Once an item has shipped, cancellation is not possible. The order can then be canceled for a refund of the purchase price less shipping costs and a 20% restocking fee on full retail price before any discounts. In most cases custom, special order and non-returnable items cannot be cancelled. Cancellation requests may take several days to process and you will be sent an email upon confirmation.

 

SECTION 24 – CUSTOM AND UPHOLSTERY ORDERS

Custom and upholstery items are made to order especially for you and may only be canceled or changed within 24 hours of submitting the order. We do not accept returns on these items. After 24 hours, custom orders are non-refundable. Final sale items are not eligible for return or exchange.

 

SECTION 25 – ORIGINAL SHIPPING COSTS

Original shipping costs are not refundable.

 

SECTION 26 – HOW TO INITIATE A RETURN

If you would like to return an item that you have received in the last 5 business days, you will need to request a Return Authorization (RA) by emailing us at customercare@rousehome.com. Once your return request has been authorized you will be given instructions on how to return your item back to our warehouse. Return authorizations expire 10 days after they are issued so please initiate shipment within this timeframe.

 

SECTION 27 – DAMAGES

Damages to the merchandise while in transit or defects in manufacturing are rare, but occasionally they do occur. IT IS REQUIRED TO FULLY INSPECT YOUR ORDER AT THE TIME OF DELIVERY AND RECORD THE DAMAGE OR DEFECT ON THE DELIVERY PAPERWORK. 

It is required that your delivery be refused in the event there is a damage or defect to your item. Returns will not be accepted for damaged or defective items that have been accepted, delivered and/or installed. Replacements will not be issued for damaged or defective items that have been accepted, delivered and/or installed.

If you refuse your delivery due to damage or manufacturing defect, the following will be required in order for a replacement be issued:

Photos of the damaged or defective item

Photos of packaging

Photos of identifying labels on the packaging

Notation of the damage or defect on the carrier’s delivery documentation

Photo of the carrier document with damage/defect noted

The damaged item will be brought back to the local delivery terminal. We will then review and evaluate the condition of the piece, so that we can determine how to resolve the issue. We ask that you please call our Customer Care team at 888-339-1453, or email us at customercare@rousehome.com, if there are any issues at all with your furniture delivery. We’ll assist you promptly.

 

SECTION 28 – WARRANTIES

Most of our manufacturers guarantee their products with a warranty. Please contact us if you have questions regarding specific product warranties.

Rouse Home and its suppliers shall not be liable for any indirect, special, consequential, or incidental damages including, without limitation, lost profits or revenues, costs of replacement goods, loss or damage to goods or services arising out of the use or inability to use this site or any product purchased from Rouse Home, damages resulting from use of or reliance on the information present, even if Rouse Home or its suppliers have been advised of the possibility of such damages.

 

SECTION 29 – SHIPPING 

Rouse Home can ship to street addresses in the continental U.S. Custom shipping quotes are available for deliveries to Alaska, Hawaii and Canada. Please contact us for more information.

Because most of our products are shipped via FedEx, we cannot deliver to P.O. Boxes or APO/FPO addresses. Rouse Home does not ship to U.S. Territories, including Puerto Rico and Guam.

SECTION 30 – SHIPPING RATES

Standard Delivery

Most items on Rouse Home ship at no additional cost and are noted as “Free Shipping” on their product detail page. Standard Delivery offers doorstep delivery of your order in its original packaging. Keep in mind if you live in an apartment or condominium complex, this delivery option will only deliver your items as far as the front entrance of your building. This service level does not include delivery inside your home, unpacking and/or assembly. If you require additional service with the delivery of your purchase, we suggest choosing our White Glove Delivery Service option.

White Glove Delivery – $199 (one item). $100 for each additional White Glove Delivery eligible item. 

Our premium White Glove Delivery service includes a scheduled appointment from one of our certified white glove delivery teams, placement of the item into your room of choice, light assembly (for instance, attach legs or insert hardware), and disposal of the packaging materials. Our White Glove Delivery Service teams are not bonded or insured for any wall mounting, structural modifications or electrical work.

Freight Fees 

If your order does not qualify for free shipping, any associated shipping costs will be listed in cart.

 

SECTION 31 – RESCHEDULING

We understand timing is important, so if you need to reschedule the date, contact the delivery provider as soon as possible at the phone number listed in your order confirmation. We request a 48-hour notice if you want to reschedule or cancel delivery. Additional fees will incur if you reschedule less than 48 hours prior to delivery, if no one is home when the delivery team arrives, or if you change your delivery address after an item ships. If delivery does not take place within 30 days of the original scheduled delivery date, the order may be treated as a canceled order. 

 

SECTION 32 – THINGS TO KNOW ABOUT WHITE GLOVE DELIVERY

Shortly before the arrival date, our delivery service will contact you to schedule a delivery appointment. Items will not be delivered without an appointment.

Deliveries are made Monday through Friday 8am-5pm. Weekend delivery is not available.

Please make sure an adult 18 or older will be home during the delivery window. The delivery window may vary depending on your location. Usually there is a four-hour window, but sometimes it is greater.

The delivery service cannot make any modifications to your home. Please measure your space (doorways, elevators, stairways, etc.) before buying the item to ensure it will fit into your home. If the item doesn’t fit, it will be sent back to us. Return shipping charges will be deducted from the amount of your refund. The original shipping charges will not be refunded.

If you’ve purchased multiple items shipping via White Glove Delivery, you may have multiple delivery appointments with different delivery companies. We work with several delivery companies, depending on the type of product and where it’s located.

Please contact us at 888-339-1453 if there could be any delivery challenges at your home such as multiple flights of stairs or a narrow or long driveway. Additional charges may apply.

 

SECTION 33 –  ADDITIONAL SHIPPING CHARGES

Some of our items require additional charges to ensure they arrive at your home in safe and sound condition. Artwork, lighting, glass and delicate items may need to be securely carted and packaged, and glass lampshades may require special handling fees. Any additional shipping charge above our standard shipping cost is noted on the product page as a “delivery surcharge”.

Any changes to the shipping address after an item has shipped or missed delivery appointments will incur additional charges.

 

SECTION 34 – MULTIPLE SHIPMENTS

If you have a large order and one item is going to cause a delay or is backordered, we may ship your order in multiple shipments. You will not pay any extra shipping charges for the extra shipment(s).

 

SECTION 35 – SHIPPING TIME FRAMES

Estimated ship times are located on each product page and indicate when an item ships from the warehouse. Due to the custom nature of many of our items, delivery lead times will vary. It is important to note that these are estimated shipping times and are subject to availability of products and/or manufacturer’s availability. If a product you have ordered is out of stock or on backorder, we will contact you with a shipment date and you can decide to either keep the order as is, cancel the item or cancel the entire order. Occasionally issues arise that may lead to additional production time, such as our manufacturers experiencing a backup in production. If this is the case you will be alerted as soon as we are made aware that a problem exists. If you need to verify stock information and availability prior to placing your order, please contact customer service at customercare@rousehome.com.

 

SECTION 36 – INTERNATIONAL SHIPPING 

We are happy to ship orders internationally. Please contact us for more information and for a shipping quote before placing your order. Please note that our typical international delivery is to the nearest port of entry and the customer is responsible for customs and duties. The recipient will be responsible for these charges that are customarily collected at time of delivery. Alternative arrangements can be made in certain instances.

 

SECTION 37 – TRACKING YOUR ORDER

Tracking information will be emailed to you once your order has shipped. Please note that it could take up to 24 hours from the time your order leaves the warehouse to the time the information is available on the carrier’s website.
